Categories of understanding Shariah

1)Fiqh:
Fiqh is an Arabic word which means to understand .This is the Islamic concept of Islamic science of jurisprudence.Fiqh referred to comprehensive of the subsidiary Shriah ruling along with the specific evidence which substantiate them. These evidences can be from Quran and sunnah, Ijma(scholarly consensus) and valid forms of analogy.
Difference between Fiqhi &Haafidh:
Fiqhi: is who, who gives ruling with understanding .He understand the situation and gives the ruling .
Hafidh: memorize without understanding.

2) Shariah: Ahkaam Shrariah or Islamic ruling  are five :
*      . Ahkaam taklifia(defining law)
*      Ahkaam Al-wadiya(secondary or declaratory laws)

*       Ahkaam taklifia(defining law):
Above five are also called Ahkaam Taklifia.Ahkaam means ruling and takleefia refers to whom communication is made in the form of the demand or option e.g. Allah says Aqeemo- wassalah and zakkah that is command and demand  ,we have to do or we have option like Mandoob,Masnóon 
·         Wajib
·         Mandoob
·         Mubaah
·         Makrooh
·         Haraam




o   Wajib:
                      This is obligatory to act, it is binding demand .It is obligatory on the Mukkalf ( a       believer who reaches puberty and has sound understanding).
They must apply Shraiah ruling meaning if they will not apply and act Shraiah ruling with is ordered and commanded by Allah (swt) then they are punishable. And if believers act upon  commands of Allah  (swt),then they are rewarded in this world and Aakhra. For example, we have five daily prayers, fasting in month of Ramadan, paying zakkah and going Hajj.

o   Mandoob (masnoon or Sunnah): It is recommended as demand from law giver which ask Mukkalaf to do and this is not binding. For example: Superogatory prayers (nafal prayers), sunnah which are not fardh,Sadaqa(voluntary charity),visiting sick etc.
If you comply mandoo,sunnah, masnon you will be rewarded in this world and Akhra and if you don’t comply it doesnot fall you in the limits of punishment.Simply,if you do ,you will be rewarded and if you leave you will not be punished.

o   Mubbaah(permissible):

It is permissible which means if you do or leave no problem eating,Qaloola(sshort sleep in noon)

o   Makrooh(Disliked):

It is disliked b Allah (swt), for example, law giver demand from Mukkalaf (Muslim or believers) to avoid something but not binding on you. If someone does Makrooh but she /he is not liable of punishment. If person Makrooh then he is liable of rewards. For example, eating unpleasant food which is makrooh because it spoils your health.

o   Haraam:
 It is binding law by law giver on the believer in respect to abandon something. There is demand to void something is binding, no choice has been given to adopt another option e.g zina is haraam then it is haraam, no choice is in it.



*   Ahkaam Al-wadiya(secondary or declaratory laws):

·         Sharat(condition)
·         Maan’(Hinderance)
·         Saheeh(correct)
·         Fasid(incorrect)

o   Sharat(condition):
condition is made to make actions correct taking out incorrect things.something that hastobe existed before envoking of the related action.It means sharat refers to aspect which must take place  or exist before invoking of the related item.Forexample,salah is waajib  and for making salah some conditions has to be made like wudu(ablution).

Widu is the state of ritual cleanessness to make salah correct.If does not have wudu then salah will not be correct.Another example is  for stealing condition is to cut hand on the required amount  .If condition does not match or meet  then cutting hands are not wajib.for zakkah condition is lenth of year  when person must have amount then zakkah is wajib.

o   Maan’:Hinderances,prevention:
If maan’ is present then rulling is absent because it nullifies because it dictate the hinderance.For example, salah is wajib on women but  during mensis  salah is not wajib on women because  of preventing factor which lift  rulling .Therefore ,we say,its presence neccessiated the absence of rulling.It means presence of mensis  necessitated the absence of rulling of salah as wajib.
Another example we can see in case of Shubah(dounbt) where there is doubt e.g if some steals money but there is doubt that who has stolen the amount wether father or son (who is liable for the punishment to cut the hands) and in this way this matter falls into the catogry of shubah meaning presence of doubt and having doubt in particular case known as a hinderance(maan’).So person s hands will nt be cut as situation is doubtful that who has stolen the money wether father or son.

o   Saheeh(correct):
Saheeh means  correct or valid,forexample if someone say I rendered sallah with wudu .then we say is salah met with all conditions without hindrances then salah is correct. Incase, any women say I rendered wudu and performed salah but was in  mensis or without wudu then her salah is fasid (incorrect).

               For saheeh action all conditions should  be present  and all hinderances will be absent then action is               saheeh.In the saheeh action you reap the fruits of actions(rewards).


o   Faasid(incorredt or null):
Opposite of saheeh .It means action is null and avoidable meaning the act of worship you did is incorrect not deserve for rewards because your action was not correct.
              For example salah without wudu or any sharat is misplaced or additional thing is added.
             Fasid and saheeh has contradictory relationship.

Ruling on the seeking of knowledge:

Waajibul aa’n:
means compulsory over every muslim.Forexample zakkah

Fardh Kafaaya:
 Not obligatory on all Muslims but few muslim has knowledge which lift obligation from the rest of the society.

[241] The principle here is the statement of Allah:

{O you who believe, decreed upon you is fasting as it was decreed upon those before you…} [al-Baqarah: 2:183-187]



• It is well-know that we have been obligated to fast the month of Ramadaan based on the ayah, {The month of Ramadan in which was revealed the Qur'ân, a guidance for mankind and clear proofs for the guidance and the Criterion (between right and wrong). So, whoever of you sights (the crescent on the first night of) the month (of Ramadan, i.e. is present at his home), he must observe Saum (fasts) that month…} [Al-Baqarah 2:185]

Starting the Month of Ramadaan
• Start fasting by one of 2 events:
1. when we see the hilaal (crescent)
2. complete Shaabaan as 30 days

• How can the hilaal be sighted? It may be with the naked eye or by using instruments – binoculars etc.

If the hilaal is seen in one country is it obligatory for everyone in other countries to fast based on this sighting?

 There is difference in this issue; it is an old difference of opinion.

 There is no solid evidence that supports one view over the next.

 We are of the view that if the hilaal is sighted in one country then everyone in the world should fast.

 However, other `Ulamaa’ differ with this view and it is not a problem to follow their view.

 This should not be a point of disunity amongst the Muslims.

 However, the whole country should start on the same day to avoid disunity within the country.

 If different countries start on different days this is not considered disunity.

What does a Muslim do with regard to fasting?

1. In a Muslim country one should fast when everyone else in the country fasts as Rasoolullaah _ said, “Fasting is when everyone else fasts.”

2. A Muslim in a non-Muslim country – upon each and every one of them to follow the Islaamic center where they perform salaah – the center should have a methodology for sighting the moon and conveying the information to the Muslims there.


Goal of fasting to gain taqwa



[242] Fasting is obligatory upon every

[1] - Muslim, who is

[2] - Adult

[3] - Sane

[4] - Able to fast


[5] And is done upon sighting the crescent or the completion of thirty days of the month of Sha’ban. The Prophet (r): “Whenever you sight the new moon (of the month of Ramadhan) observe fast, and when you sight it (the new moon of Shawwal) break it, and if the sky is cloudy, then complete it.” [Agreed Upon]

In another narration of this, there is the wording: “…then complete thirty days of Sha’ban.” [al-Bukhari]

[243] Fasting can begin due to the sighting (of the crescent) by one reliable man, but for all other months, two witnesses are required.

[244] For the obligatory fast, prior intention is obligatory, but for the

• Must have clear intention to fast the night before the fast in Ramadan

• In Arabic it is called tabyeet an-niyyah and it refers to having a clear intention from the night before the fasting actually starts

[245] superogatory one, it is permissible to make the intention during the day of fasting itself.

[246] Those who are sick and would be harmed by fasting and those who are travelling have the choice of whether to fast or not.

[247] It is forbidden for menstruating women as well as those in postpartum bleeding to fast, however they should make up any missed fasting at a later date.

[248] If a pregnant or nursing women fears harm for their child (because of fasting), they should not do so and must make up for any missed days as well as feeding a poor person for every day missed.

[249] Those unable to fast due to old age or because of a sickness of which there is no; should feed a poor person for every missed day.

Who is obligated to fast and who is exempt

• Compulsory upon an upright, healthy Muslim – one able to fast. [242]

• Exceptions fall into 3 categories - one who does not fast and: [see 246 – 249]

1. Must feed the poor for each day missed but not make up the fast after Ramadaan. Includes ‘unable elderly’, those with long-term/terminal sickness for which there is no cure.

2. Must make up fast for each day missed but not feed the poor – traveler, woman in menses, sick person (temporary illness)

3. Must fast and feed the poor for each day missed – pregnant woman and breastfeeding mother who fears for the life of the fetus/child

[250] Whoever breaks his fast needs to offer a single (day’s) expiation only, regardless of whether it is due to eating, drinking, intentional vomiting, cupping or by ejaculation due to foreplay.

When is the fast invalidated?

• The fast is considered nullified when food, drink, or what one feeds with goes down the throat.

• If one puts a thing in his mouth but does not swallow it, the fast is not considered as broken, but if it reaches the throat then the fast is invalidated.

[251] However, he who breaks his fast through sexual intercourse must make up for that day and free a slave, and if he is unable to do so then he must fast sixty consecutive days, and if he is unable to do that, then he should feed sixty poor persons.

Kaffaarah for breaking the fast

This is a point of difference.

The kaffaarah is of 2 types:

1. Major Kaffaarah - Al-Kaffaarah al-mugalladah – the more severe penalty - fasting 2 consecutive months if one is unable to free a slave

• Imaam Ahmad and Imaam ash-Shafi`ee say that one is penalized with this kaffaarah for having intercourse during the day of Ramadaan. This type of penalty does not apply if the fast is broken with food or drink.

• Imaam Maalik and Imaam Abu Haneefah say that this kaffaarah is for anyone who breaks his fast in Ramadaan without a valid excuse – whether due to marital relations or even eating/drinking

2. Minor Kaffaarah

[252] The Prophet (r) said: “Whoever eats or drinks forgetfully should continue and complete his fast for it was Allah that fed him or gave him water.” [Agreed Upon]

• Imaam Maalik says that the fast of one who eats/drinks unintentionally is invalid.

• Preferred view is that of the majority – that the fast is still valid based on the hadeeth in pt. 252.

Recommended acts when fasting

[253] And also: “People will remain upon goodness as long as they hasten to break their fast.” [Agreed Upon]

[254] And also: “Eat the Suhoor (pre-dawn meal), for in it is a blessing.” [Agreed Upon]

[255] And also: “When any of you breaks his fast, let him do so with dates, and if he does not find them, then with water, as it is a purifier.” [The ‘Five’]

Recommended acts when fasting

1. Part-taking of suhoor (pre-dawn meal)

2. Break fast immediately when time comes in

3. Break fast with dates

Goal for Fasting

[256] And also: “Allah does not need the fast of one who does not abandon false speech or acting according to his false speech.” [al-Bukhari]

The goal of the Sharee`ah is to have the opportunity to attain taqwaa. If one indulges in false speech etc. it will prevent them from attaining taqwaa


[257] And also: “The heirs should fast on behalf of those who died owing fasts” [Agreed Upon]

Recommended days to fast:

• Mondays, Thursdays

• 13th, 14th, and 15th of the Islamic month

• 6 days in Shawwal,

• Aashooraa,

• Day of `Arafah

Prohibited days to fast

• 2 days of `Eed,

• Days of Tashreeq i.e. 11-13th Dhul HIjjah,

• Day of Jumu`ah

[258] The Prophet (r) was asked about superogatory fasting on the day of ‘Arafah and he replied: “It is an expiation for (the sins) of the past year and the coming year.”

[259] He (s) was also asked about superogatory fasting on the day of ‘Ashura’, and he replied: “It is an expiation for (the sins of) the past year.”

[260] He (s) was also asked about superogatory fasting on Mondays and he replied: “That was the day I was born, and the day I was commissioned with Prophethood, and day I first received revelation.” [Muslim]

[261] The Prophet (r): “Whoever fasts the month of Ramadhan and then follows up with six fasts in the month of Shawwal, it is as if he fasts perpetually.” [Muslim]

[262] Abu Dharr (may Allah be pleased with him) said: “The Prophet (r) commanded us to fast three days of every month: the thirteenth, fourteenth and fifteenth.” [An-Nasa’i, At-Tirmithi]

[263] Also, he (s) forbade fasting on two days: “The day of (‘Eed) al- Fitr and the day of Nahr (i.e., ‘Eed al-Adh’ha).” [Agreed Upon]

[264 ]He (s) said: “The days of Tashriq (in Hajj) are days of eating, drinking and remembering Allah the Glorious.” [Muslim]

[265] He (s) also said: “None of you should fast on a Friday unless he intends to also fast the day before it or the day after it.” [Agreed Upon]

[266] He (s) also said: “All the past sins are forgiven for whoever fasts Ramadhan faithfully and with the hope of reward. All thepast sins are forgiven for whoever stands in prayer on the Night of Decree faithfully and with the hope of reward.” [Agreed Upon]

I`tikaaf:

• I`tikaaf – staying in the masjid whilst worshipping Allaah _ and gaining closeness to Him _.

• It is not from the condition of i`tikaaf that one is fasting.

• It can be done for a short period e.g. between Dhuhr and `Asr.

• It is upon one in i`tikaaf to gain closeness to Allaah _ by doing as many acts of `ibaadah as can be performed.

[268] The Prophet _ said: “One should not undertake a religious journey except to three mosques: al-Masjid alharam (in Makkah), this mosque of mine (in al-Madinah), and the Farthest Mosque (in Jerusalem).” [Agreed Upon]

This means that one should not intend to visit a specific place except the 3 mentioned in the hadeeth.

• Zakaah is from the pillars of Islam:  

Ibn ‘Umar quoted the Messenger of Allaah (r) as saying, “Islaam is built on five [pillars]: the

declaration that there is no god worthy of worship besides Allaah and that Muhammad is the

Messenger of Allaah; establishment of Salaah; payment of Zakaah; Hajj; and fasting Ramadaan. [Bukhari]



• Zakkah literally mean to purify, purify one’s wealth and purify oneself. Allah says:



خُذۡ مِنۡ أَمۡوَٲلِهِمۡ صَدَقَةً۬ تُطَهِّرُهُمۡ وَتُزَكِّيہِم بِہَا وَصَلِّ عَلَيۡهِمۡ‌ۖ إِنَّ صَلَوٰتَكَ سَكَنٌ۬ لَّهُمۡ‌ۗ وَٱللَّهُ سَمِيعٌ عَلِيمٌ

“Of their wealth take alms, that so thou mightest purify and sanctify them; and pray on their behalf. Verily thy prayers are a source of security for them: and Allah is One Who heareth and knoweth.” [ Sura Tawba, ayah 103]



• By paying out your zakaah you are making an investment in yourself – increase in manifold



وَمَآ ءَاتَيۡتُم مِّن رِّبً۬ا لِّيَرۡبُوَاْ فِىٓ أَمۡوَٲلِ ٱلنَّاسِ فَلَا يَرۡبُواْ عِندَ ٱللَّهِ‌ۖ وَمَآ ءَاتَيۡتُم مِّن زَكَوٰةٍ۬ تُرِيدُونَ وَجۡهَ ٱللَّهِ فَأُوْلَـٰٓٮِٕكَ هُمُ ٱلۡمُضۡعِفُونَ

“And whatever you lay out as usury, so that it may increase in the property of men, it shall not increase with Allah; and whatever you give in charity, desiring Allah's pleasure-- it is these (persons) that shall get manifold.” [Sura Rum, ayah 39]


• Hadith –“there is no zakat in wealth until one lunar year is completed” – (Abu Dawood -1573-)

[201] This is obligatory upon:

1. [1] every Muslim who is

2. [2] free and

3. [3] possesses the Nisaab (minimal amount that if possessed; makes Zakaah compulsory).

[211] Zakaah is not obligatory upon one's wealth, until a full lunar year has elapsed since its possession, with the exception of:

• There are two exception to the rule, there is no zakat in wealth until one lunar year is completed:

[1] - What comes out of the ground (i.e. agricultural produce).

• anything harvested from the earth – pay the zakat immediately – on the day of harvest/extraction

[2] - Whatever is produced/earned from one's original assets such as the offspring of livestock

and profits from trade. This is because it's 'hawl' (complete lunar year) is calculated based on the timeline of one's original assets, if it had reached the minimal amount (nisaab)

• If you had the minimal amount that makes you liable to pay zakaah, on January 1st 2009- you 'zakaah financial year' would end the following January. So if the minimal amount was 1000 riyals, but on the 31st of December 2009 you made a profit in a deal and acquired 5000 riyals...thus driving your total assets to 6000 riyals, you are required to pay zakaah on 6000 riyals on January 1st 2010, because the 5000 riyals you made follows the same 'zakaah' timeline as the minimal amount you had the previous year, since that was your original capital. (Please learn financial terminologies)

• Wealth and merchandise – after a complete year of possession; you have to pay zakaah on them if the total amount reaches the nisaab. If your zakaah financial year ends every January...you look at the profits available from the sale of your merchandise, and value your merchandise based on the selling price every January, and pay zakaah on that amount. You do not pay zakaah a year after each sale was made, as this would constitute you paying zakaah everyday of every year.

• The principle is that from the outset, zakaah is not compulsory unless in possession for 1 lunar year [explanation from Sh Sajid]


[212] Zakaah is not applicable except in the following four cases:

[1] - The Sa’imah from cattle (i.e., the offspring of cattle that have grazed independently for a year),

• Sa’imah – refers to those animals that graze freely; cows, camel, goat and sheep,

• those animals you have to feed , do not pay zakat on them

[2] - What comes out of the ground,

• Those that is harvested, weighed and stored.

• Can be stored without chemicals, refrigeration or preservatives

• For example don’t pay zakah on perishable items; oranges and apples


[3] – Treasures,

• Gold and silver, or money you possess

[4] – Merchandise.

• Those goods that you have an intention to sell, whether you display them or not


Zakaah on the 'Sa’ima'h

[213] As for case of the Sa’imah ; then this is based on the Hadith of Anas (may Allah be pleased with him), where Abu Bakr (may Allah be pleased with him) wrote to him, saying: “This concerns the obligation of Zakah which the Messenger of Allah, (may Allah bless him and grant him peace) made obligatory for the Muslims and which Allah commanded His Messenger with:

Nisab

• This is the minimum amount that you must possess before paying zakaah

Nisab on Saimah

1. Camels

• Camels – 24 or less – sheep are to be paid as zakaah

• For every 5 camels – 1 sheep

• 25 to 35 camels – a 1yr old she camel is paid, if not available, then a 2yr old male camel

• 36 to 45 camels – a 2yr old she-camel,

• 46 to 60 camels – a 3yr old she-camel – fit for breeding

• 61 to75 camels – a 4yr old she-camel whose udders have formed

• 76 to 90 camels – 2 – year old she-camels

• 91 to 120 camels – 2- 3yr old camels – fit for breeding

• More than 120 camels – for every 40 (over 120) – a 2yr old she-camel

• More than 120 camels – for every 50 (over 120) – a 3yr old she-camel fit for breeding

• Have only 4 camels – does not have to pay zakaah (unless he wishes to do so)

…For twenty-four camels or less, sheep are to be paid as Zakaah; for every five camels one sheep is to be paid.. And if there are between twenty-five to thirty-five camels, one 'Bint Makhad ( a one year old she-camel) is to be paid or, in the absence of a one year old she-camel, a 'ibn Laboon' ( a two year old male-camel). From thirtysix to forty-five, one 'bint laboon' (a two year old she-camel) is to be paid. From forty-six to sixty, one 'hiqqah' is to be paid ( a three-year old she-camel fit for breeding). From sixty-one to seventy-five, one 'Jaza'ah' is to be paid ( a four-year old she-camel whose udders have formed). From seventy-six to ninety (camels), two 'bint laboons' (two-year old she-camels) are to be paid. From ninety-one to one hundred and twenty (camels), two 'hiqqahs' ( three-year old she camels fit for breeding) are to be paid. If there are more than one hundred and twenty (camels), for every forty (over 120), one 'bint

laboon' is to be paid, and for every fifty camels (over 120) one 'hiqqah' is to be paid, and whoever has only four camels, does not have to pay any Zakaah unless he wishes to.

Zakaah on sheep

As for the Zakaah of grazing sheep; then from forty to one hundred and twenty, one has to pay one sheep as Zakaah. If there are between one hundred and twenty one and two hundred, it is required

to pay two sheep.. And If there are between two hundred and one and three hundred, one must pay three sheep., and If there are more than three hundred; then for every hundred above this (300), another

sheep must be paid. If a man's flock is less than forty sheep there is no Zakaah on them unless the owner wishes.

2. Sheep

• 40 - 100 sheep – pay 1 sheep as zakaah

• 121 – 200 sheep – 2 sheep

• 201-300 sheep – 3 sheep

• More than 300 (for every 100 over 300) - 1 sheep

• Less than 40 sheep – no sheep unless owner wishes

It is not permissible for one to combine different groups, nor divide flocks of one type, to avoid paying Zakaah on them. If the animals are co-owned, then the owners should pay the Zakaah collectively.

-It is not permissible to pay in Zakaah an animal that has reached old age or is defective.

- And for silver the 'nisaa'b is two-hundred Dirhams, of which one fortieth (is to be given). If the amount is only one hundred and ninety Dirhams, nothing is owed unless the owner wishes.

Whoever has to pay in Zakah a four-year old she-camel but does not possess one, and instead has a three-year old she- camel; then that would be acceptable, but he should add to that two sheep if he is

able, and if not, he should add twenty Dirhams. Whoever owes in Zakah a three-year old she-camel but does not possess it, but instead has a four-year old, that would be accepted from him and in in return, the Zakah collector should give him twenty Dirhams or two sheep.” [alBukhari]


[214] And in the Hadith of Mu’aadh (may Allah be pleased with him) it states that: “The Prophet (r) commanded him to take from every thirty cows a one-year old calf, male or female, and from every forty

(cows)a two-year old she-calf.” [Ahl As-Sunan]

3. Cows

• For every 30 cows – a 1yr old calf (male or female)

• For every 40 cows – a 2yr old she calf


[215] For the Zakaah on treasure, then we have already mentioned that none is payable until the amount reaches the equivalent of 200 Dirhams, in which case a fortieth is payable.

• The Nisaab for treasure – 200 dirhams

• The Nisaab of Gold is 20 Dinaar's (85 grams of gold)

• The Nisaab of Silver is 200 Dirhams (595 grams of silver)

• Money has taken the place of gold and silver thus the nisaab of financial wealth is either 20 Dinaar's or 200 Dirhams

• Sh. Sajid explains:

The lower value should be used, as this is more beneficial to the poor.

The general rule in Zakaah is that the action most beneficial to the poor must be performed.

That is why the value of silver is normally concentrated upon, because it is generally lower in value than gold.

However if we are ever to have a scenario where gold was lower in value than silver, then the value of gold would be considered. And Allah knows best.

[216] As for the Zakaah that is payable on what comes out from the ground, whether grain or crops, the Prophet (r) said: “There is no Zakaah payable on less than five Wasqs of dates.” [Agreed Upon]

One Wasq is equivalent to 60 Saa’s. Thus, the Nisaab for grain and fruit is 300 Saa’s of the Prophet(s)

(Note: A 'wasq' and 'saa' are types of measurements. A 'saa' is approximately 3264 grams in weight)



• Nisab for grain and fruits – 300 saa’s , 1 saa = 3264 grams, 300 x 3264 = 979,200 grams



[217] Also, the Prophet(s): “There is a tenth on land watered by the sky or springs or running springs. There is a twentieth (5%) on land watered through irrigation.” [al-Bukhari]



[218] Sahl ibn Abu Huthman (may Allah be pleased with him) said: “The Prophet (r) ordered us: ‘Harvest all but a third; if you cannot leave a third, then leave a quarter.’” [Ahl As-Sunan]



Questions and Answers

1. Is it permissible to wipe over socks with small holes? We say, yes its permissible

2. Does salatul janaza have 1 or 2 tasleems? Some hadith say 1, some say 2, we are of the opinion that it is one tasleem. Not a major point of difference.

3. Where to place the hands in qunoot? Hand should be risen – like when they are making dua

4. The issue of a person who is chewing gum in salah– does this invalidate the salah? If the taste the gum and goes down one throat , salah is invalidated, but if it does not go down the throat, salah is ok. However this is disliked

5. What if you are late and join the jama in ruku – if u are in doubt that the imam stood up, then complete the unit after the imam completes the prayer.

6. Can you perform salatul janaza if the dead person is not in your presence? The P(s) never prayed this salah except for Najashi, because no one did that (perform salatul Janaza) in his country. Another reason why his janaza was done was because of his strong support for Islam.

7. For sajda tilaawa – do you say the takbeer or not? If you are in the salah, you do the takbeer before making sujood at tilaawa. However, if you are not in the salah, you do not say the takbeer before sujood. The Hadith of Abi dawood is weak, so the preferred view is not to say takbeer out of salah

8. Is it permissible to hold the Quran in salah? This is not allowed in obligatory prayers, but allowed in voluntary salah because Aisha(r) did it. The preferred view is to do it. The Hanafee madhab says it is not allowed, but this is not the correct view.

9. The tahiyyatul masjid for haram (Makkah), is it tawaf or salah? As for it being tawaf – this hadith is weak. The general hadith mentioning that we should pray two units when you enter the masjid before sitting down encompasses all masjids including the Haram, so pray the two units.



10. When you say salaam to dead person – can he hear you? Yes, if you are near his grave. However In regards to the P (s), he can hear your salaam from wherever you are.



11. Utensils made with bone china are made from animal bones. Is it allowed to use such utensils? If it was from bones of animals that are allowed to eat from and the animal was sacrificed, then it is ok. But if the bones were from a haram animal, and/or the animal was not sacrificed – it is not allowed to use it.



12. Does the salah of eclipse remove the obligatory salah? No, it is an independent salah. If the eclipse coincides with the obligatory salah, first render the obligatory prayer, then the salah of eclipse. It does not take the place of obligatory salah.

Zakaah on Merchandise


[219] As for merchandise; then this is defined as all that which is used in buying and selling for a profit.

• Merchandise are those goods that we intend to sell

[220] zakaah is due on all such goods at the end of a specified duration.

• You have to pay zakaah on merchandise if a complete lunar year has passed

• Start calculate year from the time when you intend to sell the goods and not on the time you own the goods.

• During that time if you change the goods - sell the goods for cash and buy more goods, this does not break your initial (zakaah) timeline

[221]The Zakaah on this should be a fortieth of the highest price estimate of such goods, for the benefit of the poor, payable in gold or silver.

• how we work it out for zakaah on merchandise? You need to know the market value of goods then divide by 40, so if the market value of your goods is 40,000 riyals then divide by 40 = 1000 riyals

[222] No Zakaah is payable for whoever is in debt or whoever has loaned out wealth with no hope of a near return, for example one who has loaned it to a person who is known to delay in repayment, or to a

poor person who is unable to easily repay and has not fixed a time for repayment.

• Does debt prevent you from paying zakah? If person is not poor and he can pay his debt, then zakah is compulsory , but if he is poor and can’t pay his debt then zakaah is not wajib on him

• For example, you lent out money to a person who is known as not to pay back, then when you calculate your zakaah do not include the amount you lent him.

• Obviously if the person is poor and is in debt and can’t pay back his debt, then zakaah is not wajib on him

• However, if the mumatil (the one who delays in paying), pays you - when the money comes back to you – you pay 2.5 %

• Zakaah is waajib on a person if they are in debt, but able to pay it, and only delay payment for no valid reason.

- [223] However, if the person has fixed a time for repayment, then Zakaah is payable.

• If you lent money to person who can pay you back on time, then when you calculate your zakaah you include that amount that you lent him.

[224] Zakah is to be taken from the median wealth of the person and if he gives it from

[225] the most inferior (in value) of it, then it will not be rewarded. He need not give from the

[226] most superior of it but may do so if he wishes.

[227] Abu Hurayrah (may Allah be pleased with him) narrated that: “There is a fifth (payable) upon buried treasure.” [Agreed Upon]


Chapter: Zakah al-Fitr

[228] Ibn ‘Umar (may Allah be pleased with him and his father) related that: “The Prophet(s) prescribed the payment of Zakah al-Fitr as one Saa' of dates or one Saa' of barley for every slave and freeman, whether male and female, young old, among the Muslims and ordered that it be paid before the people go out to the Eid Prayer..” [Agreed Upon]



• Wisdom behind the zakaah ul fitr

• Zakatul fitr – Allah kept you in existence for the period of the year,

• cleanse yourself from mistakes you may have committed in Ramadaan – idle talk, misuse of tongue, etc

• Give opportunity to poor to participate in Eid,


[229] This is an obligation upon

[1] oneself and those under his care if

[2] they have in excess of what would suffice themselves for the day and night of ‘Eed.

[3] The amount to be given is a Saa’ of dates, or barley, or dry cottage cheese, or raisins, or bran, and

• A saa’ of 5 things mentioned above, should be given

• Ulama differ as to what we can give out, can we give other that the 5 things mentioned?

• 1st view – only the 5 things (dates, barley, dry cottage cheese, raisins, or bran)

• 2nd view – give the staple diet of the country you are living in (i.e. rice)

• 3rd view – give equivalent in cash

• The preferred view is the 2nd view because this will do justice to the need of the poor person



[230] the most preferable is that which is the most beneficial (to the recipient).



[231] It is not permissible to delay giving it beyond the day of ‘Eid.

• It should be given on Eid day, or 1 or 2 days before Eid



[232] The Prophet ( ) prescribed this as a means of purification for the one who observed Ramadhaan from the evil and shameful talk (that may have occurred), and to feed the poor. It is acceptable if given before the Salaah (of ‘Eid), and if given later, is only counts as a simple act of charity. [Abu Dawud, Ibn Majah]



[233] The Prophet I said: “Allah will give seven (persons) protection with His shade on the Day when there will be no shade except His. (i.e., on the Day of Judgment, and they are): a just ruler, a youth who grew up worshipping Allah; a person whose heart is attached to the mosques; two persons who love each other, meeting and parting for the sake of Allah; a man whom a beautiful high-society woman seduces (for an illicit relation), but he (rejects this offer by saying): ‘I fear Allah’; a

person who gives charity and conceals it (to such an extent) that his right hand would not know what the left has given; and a person who remembers Allah in privacy and his eyes therefore shed tears.” [Agreed Upon]



• Voluntary charity has an important place in our deen

• From the 7 who will be shaded – that his right hand would not know what the left has given



Chapter: Recipients of Zakaah



[234] Zakaah is not to be paid except to the eight categories of people mentioned by Allah in his statement: {Zakah expenditures are only for the poor and the needy and for those employed to collect [Zakah] and for bringing hearts together [for Islam] and for freeing captives [or slaves] and for

those in debt and for the cause of Allah and the [stranded] traveler – an obligation [imposed] by Allah. And Allah is Knowing and Wise.} [at-Tawbah: 9:60]


Eight categories of zakaah:

1. Poor

2. Needy

3. Administrator of zakaah

4. Bring hearts together – those who you hope will accept Islam

5. Freeing slaves

6. Those in debt

7. Fisabililah – for the cause of Allah

8. Stranded Traveller

[235] It is permissible to give it to a single person from one of these categories as the Prophet (r) said to Mu’adh (may Allah be pleased with him): “...And if they accept it [the obligation of Salaah], then

teach them that Allah has made Zakaah obligatory for them – that it should be collected from the wealthy and distributed among the poor…” [Agreed Upon]

[236] Zakaah is not to be given to:

[1] - The wealthy

[2]- Those who have the ability to earn

[3] - The family of Muhammad (s), who are the Banu Hashim and their clients.

[4] - Someone upon whom it is obligatory to provide for

[5] - A disbeliever

[237] As for Sadaqah (superogatory charity), then it may be given to these people as well as other than them.

[238] However, it is advisable to give it in a manner and path that will cause it to be a means of complete benefit.

• You can increase your rewards by the avenue u use to give out zakaah. The avenue that needs your zakaah the most – determine you getting more reward, so if a category of people are in serious need of zakaah – and you give to them, you get an increase in reward

• Spend on the poor in your family that is in need of zakaah, the rewards will be even greater


[239] The Prophet (r) said: “He who begs from the wealth of others to increase his own is in fact only asking for burning coal, so let him stop asking or increase (his punishment).” [Muslim]

[240] Also, he (s) said to ‘Umar (may Allah be pleased with him): “Take out of this wealth that which comes to you without you asking for it, otherwise, do not let your heart long for it.” [Muslim]

Who are those relatives you are allowed/not allowed to give your zakaah to:

1. Not allowed to give zakaah to a person that you will inherit from in the event of their death, because it is not allowed for the money to come back to you.


2. You can give zakaah to relatives that you will not inherit from after their death



3. Example to this; a person has 2 brothers and no father. One brother has children, the other no children. You can give your zakaah to brother with children, because if the brother with kids dies – his sons will inherit.



4. However it is not allowed to give zakaah to the other brother without kids. Why? Because if he dies, you will inherit from him. It is not allowed for the zakaah money to come back to you (in the form of inheritance)

Book Of Janaza

• Transition from this world to the next – important to perform good deeds

[192] The Prophet (r) said: “Prompt your dying ones to say, 'There is no one worthy of worship except Allah (laa ilaaha illallaah).” [Muslim]


                                                  
[193] And also: “Read 'Surah Yaaseen' over your dead.” [An-Nasaa’i, Abu Dawud]

• “Dead” refers to those who are in the period of transition from this life to the next

• Sura Yaseen has in it lessons of reality of people. Read on the one who is on their death bed, in that transition period. (however this hadeeth weak, and should not be practised upon)



[194] To prepare the dead (for burial) by washing him, shrouding him, praying Salaah over him, carrying him to his burial place and burying him is a Fardh Kifayah (collective obligation).

• If someone in the community do it – the obligation is lifted



[195] The Prophet (r) said: “Hasten with the bier for if is the deceased was righteous, then you would be expediting it to the goodness that awaits, and if he was otherwise, then you would be ridding yourselves of an evil burden.” [al-Bukhari]

• Benefits to both the person who pass away (to go to goodness) and to us – the rest of the people can go on with their lives



[196] And also: “The believers soul is suspended due to debt until it is cleared for him.” [Ahmad, at-Tirmdhi]

• This refers to the dead person, he is responsible for this debt. It is important to pay off debts immediately before death. The P (s) never used to pray on the one who had debts.



[197] It is obligatory when shrouding to use a cloth that will cover the entire body, except for the head of the Muhrim (the male person in the state of Ihram) and the face of the Muhrimah (the female person in the state of Ihram).



[198] The description of the Salaah over the deceased is as follows:

• Because Salatul Janaza is Fard kifaya – the person who offer it must stand to offer it (like other wajib salah)

[1] - To stand and make the Takbeer and recite Surah al-Faatihah

[2] - Then to make another Takbeer and send peace and blessings upon the Prophet (r).

[3] - Then to make another Takbeer and supplicate for the deceased.

• The supplication in salatul Janaza could be in any language –



This supplication is done, for example, by saying: “O Allah, forgive our living, our dead, our young, our elderly, our males and our females, those of us who are present and those who are absent. O Allah, whosoever among us You keep living, make him live upon Islam, and whosoever You cause to die, let him die in a state of Islaam.”

(Allaahummagh-firlee hayyinna wa mayyitina, wa sagheerina wa wa kabeerina, wa shaahidina wa

ghaa’ibina, wa dhakarina wa unthaana. Allaahuma man ahyaytahu minna fa ahyihi ‘ala’l Islaam, wa man tawaffayathu, fa tawaffihi ala’l eeman.)



Or: “O Allah, forgive him, have mercy upon him, excuse him, pardon him, and make honourable his reception; (O Allah) make wide his entrance, cleanse him with water, snow and ice, and purify him of sin as a white robe is purified of filth.”

(Allaahumagh-firlahu war-hamhu wa ‘aafihi, wa’fu ‘anhu, wa akrim nuzulahu, wa waasi’ adkhalahu, waghsilhu bil-maa’i wath-thalji wal barad, wa-naqqihi min adhdhunoobi kama yunuqqaa ath-thawbu’l abyadhu min addannas.)



Or: “O Allah, do not deprive us of his reward, do not put us to trial after his death and forgive him and us.” (Allaahumma la tahrimna ajrahu wa la taftinna ba’dahu, wagh-fir lanaa wa lahu.)



If the deceased is a minor, one should say after the general supplication: “O Allah, make him for his parents a forerunner, a treasure and an admonition, an honour, and an intercessor; cause him to make their scales of deeds heavier (on the Day of Reckoning) and their reward greater, place him under the custodianship of Ibrahim (Abraham, peace be upon him), and save him – by your mercy - from the punishment of the fire.”

(Allaahuma’j ‘alhu furutan liwaalidayhi wa dhukran wa shafee’an mujaaban. Allaahumu thaqqil bihi

mawaazeenahumma wa ‘adhin bihi ujoorahumma wa’j ‘alhu fee kifaalati Ibraaheema, wa qihi – bi rahmatika –‘athaab al-jaheem.)

[199] - Then, one makes another Takbeer and then a Tasleem (to complete the prayer).



[200] The Prophet (r) said: “Whenever a Muslim dies, and forty men pray over his janaazah, none of them joining anything with Allah in worship, Allah grants them intercession for him” [Muslim]

• It is good to have a large number of people to offer the salah - more supplication for the dead person and more people to offer their sympathy to the relatives of the dead person



[201] And also: “Whoever attends the funeral until the Salah is prayed (over the deceased), will have a Qirat worth of reward, and whoever attends (and stays) until till he is buried, for him is the reward of two qirats.” It was asked: “What are two qirats?” He (s) replied: “They are equivalent to two immense mountains.” [Agreed Upon]



• The qirat is One of the 24 activities that relate to the dead person



[202] Also, the Messenger of Allah (s): “Forbade [1] that graves be plastered, [2] or be sat upon, [3] or be built over.” [Muslim]

• We don’t want people to be burden themselves with the rituals of the dead. So we should not be extravagant. We must be respectful to graves – not stand nor sit, nor build structures over them



[203] When the Prophet (r) would finish the burial, he would stand at the grave and say: “Seek forgiveness for your brother and pray for his steadfastness, for he is now being questioned.” [Abu

Dawud, authenticated by al-Hakim]



[204] It is recommended to console the relatives of the deceased.

• Taaziat – console, lots of rewards, eases the difficulties of the families, by making dua, telling them of the great reward that awaits the dead person.



[205] The Prophet (r) cried for the dead and said: “This is mercy,” although

• Know that crying does not benefit the person that pass away, it is part of our natural make up to cry, that’s why the P (s) himself cried when his some members of his family member pass away



[206] he cursed the female wailers and the women who listen to their wailing.

• In sunnah – the dead is punished b/c of the crying of relatives, how do we join between this hadith and the hadith stating that the Prophet SAW cried when some family members passed away?

• What is the difference between this crying and the crying of the P(s)?. If the crying – is made to be known to the dead, then the dead feels the pain, and does not mean they are physical punishment

• In this wailing – loud screaming – no benefit to dead person – P (s) prevented this



[207] Also, he (s) said: “Visit the graves, for they remind (you) of the Hereafter.” [Muslim]

• Procedures – we look at this carefully – easy procedure

• Sharia prevents us from mass gathering at the homes of person who pass, or to set up for the gathering of people at the home

• Wisdom to visit graves – we remember the hereafter and we make dua for those who pass away



[208] The one visiting the grave should say: “Peace be upon you all, O inhabitants of the abodes of the believers. Indeed we will, Allah willing, be joining you. May Allah have mercy upon those who went before us and those coming after; We ask Allah for wellbeing for us and for you. O Allah, do not deny us from their reward and do not put us to trial after them and forgive us and them. We ask Allah wellbeing for us and for you.”

It is not permissible

And :

• for one to supplicate for himself, whoever does this is going away from the sunnah – a bidah

• Impermissible – to seek and ask from the dead person - doing so is shirk.

• No one should supplicate to other than Allah. The most misguided – the one who does so. Remember the one who is asked (the dead) cannot hear nor benefit you.

Allah Almighty said:

وَأَنَّ ٱلۡمَسَـٰجِدَ لِلَّهِ فَلَا تَدۡعُواْ مَعَ ٱللَّهِ أَحَدً۬ا

‘Wa annal masaajida lillah; fala tad'u ma'a Allahi ahada”

Verily, the mosques are for Allah (Alone), so do not pray to anyone along with Allah. [Jinn:18]



وَمَنۡ أَضَلُّ مِمَّن يَدۡعُواْ مِن دُونِ ٱللَّهِ مَن لَّا يَسۡتَجِيبُ لَهُ ۥۤ إِلَىٰ يَوۡمِ ٱلۡقِيَـٰمَةِ وَهُمۡ عَن دُعَآٮِٕهِمۡ غَـٰفِلُونَ

waman adhallu mimman yad'uu min duunillaahi man laa yastajiibu lahu ilaa yawmi lqiyaamati wahum 'an du'aa-ihim ghaafiluun.

“And who is further astray than those who, instead of Allah, pray unto such as hear not their prayer until the Day of Resurrection, and are unconscious of their prayer,” [46:5]



(Assalaamu ‘alaykum ahla qawni daari mu’mineen, wa innaa – in shaa allahu – bikum laahiqoon; wa yarhamuhullaahu almustaqdimeen wa’l musta’khireen; nas’alulaaha lana wa lakum al-‘aafiyah. Allaahumma laa tahrimna ajrahum wa laa tafteena ba’dahum, waghfir lanaa wa lahum; as’alullaaha lana wa lakum al-‘aafiyah.)



[209] And any good deed that is a means of nearness to Allah and whose reward can be gifted to the deceased should be performed, as this would benefit him. And Allah knows best.

• Giving ur rewards to dead – is this permissible or not?

• Ulama agrre – hajj umrah,. Sadaqa – allow to pass on the rewards to the dead

• In regards to other actions – read salah – nafil fast – pass to dead, there are 2 opinions:

1. It is allowed – shafi, ahmad and the author

2. Not allowed – unless the sharia stipulates the permissibility – opinion of Abu Haneefa, Malik This is the preferred opinion because these are acts of Ibadah. For acts of ibadah – one must have evidence before its allowed (i.e pass on reward to dead)



• When you visit the graveyard – there are certain ways of sending greeting to those who pass away; it should include the Salam and a dua supplication for the dead – if these 2 are present then the action is ok.

1. Is it considered Husno khatim that a person recites Suran Yasin before he dies?

Questions & Answers

1. f a sister is out and about – can she join her prayers? It is not necessary for her to pray in congregation, thus she must read all the obligatory prayers at their fixed times. She must just look for a clean place to pray wherever she is.

2. Student in university – cant pray jumuah due to conflict with class. Salatul jumuah is wajib – ask for permission from university, or exchange classes for that time. It is waajib for you to pray salatul Jumuah unless you have an excuse, and this is not an excuse.

3. Post partam bleeding – sister do not offer the salah during this time nor does she make up for these missed salah

4. Traveller who is able to fast, should he fast? Will deal with this in a later session

5. Invocation to recite after takbeer ihram. If a person does not know this dua, they can write on paper and read it – no problem. It does not affect salah if one leaves it out

6. Salatul eid – can sister render eid salah at home? Ok but reward is less , better to render in congregation

7. Qibla – not know where it is. Try to figure out where it is from the sun, moon, compass, then pray in that direction, your salah is correct even if you find out afterwards it was the wrong direction. Important to do your best.

8. What are the rituals for a child who passes away at 8mths old? He must be washed and shrouded as a regular mayyat because he has a soul.

9. How long can you console the bereaved relatives? This can happen when you meet, in salah, at home. Some ulama says 3 days. ((No person should mourn more than 3 days except the wife- for 4 mths, 10 days)) or as mentioned in the hadith.

10. Is it permissible to follow the dead body (funeral procession) when they are saying invocations that are not from the sharia? Ok but hate it – change it with his tongue, speak nicely to them. Follow it with the intention to educate and inform the family (in a nice way)- but if you are a person of authority, then you cannot join that gathering unless you are putting a stop to the mistake and bid'ah.

11. Can a husband shroud and wash body of wife? Yes, its allowed, but not allowed to look at the private parts, washing is done under a screen – sheet. And vice versa.

12. Is it permissible to recite Quran in the grave yard? No, it is not the practise of P (s)

13. Is it permissible to make supplication in congregation, that which is done after the person is buried? No. It is better to supplicate by yourself – Allah hears your prayers

14. What is the ruling of raising your hand to make dua? There are 2 opinions: 1st: allowed, 2nd not allowed as it is not from the conditions of dua to raise your hand, and if our Prophet SAW did it, we would have been informed.

15. is it ok to pray tahhajud after praying taraweh salah during the night? Yes no problem

16. The issue that the hadith saying to recite sura yaseen before the person passes away, hadith is weak – however the opinion of the author is that its ok to recite sura yaseen. We are of the opinion that this hadith is weak – so better not to practise on this hadith.

1. First part of shahaah, This actually means the actual unity of Allahu Subhanawatala

when we worship Him, each and every one should make sure that they worship Him

alone with complete sense unity – worship should be only for Allah, nobody else.

1. Al Muhabbah li maabood - Love for the one worshipping i.e. for Allah in the

complete sense – walladeena amanu ashaddu hubban lillah -

2. Al Khudoo – being humble in your worship of Allah, WORSHIP MEANS to humble

yourself.

3. Al Khouf - Wa khafooni inkuntum momineen. FEAR ME IF YOU ARE BELEIVER.

TO HUMBLE YOURSELF.

4. Ar Raja – having hope in Allah to be saved from the punishment of Allah.

2nd part of Shahadah: anna muhammadan rasoolullallah. Another 4 aspects.

a. Believing everything that Rasoolullah sallallahu alaihi wa sallam came with.

b. Following everything that Rasoolullah sallallahu alaihi wa sallam commanded us to

follow.

c. Loving Rasoolullah sallallahu alaihi wa sallam and giving precedence to his love over

and above the love for yourself, parents and everything in existence and all of

mankind in existence.

d. Don’t worship Allah except in the manner Rasoolullah sallallahu alaihi wa sallam

taught us to worship Allah.

2. Second Pillar Salah

Requirement for Salah is Taharah, is being in a state of ritual purity. Allah will not accept

the salah of a person who is not in a state of ritual purity. There are two things that

prevent one’s salah from being correct and complete – one is hadath al akber and hadith

al asgar.

a) Hadath al akber – greater state and stage of ritual impurity:

􀂾 Sexual intercourse with their spouse - junoob

􀂾 Women in Menses – monthly periods - haid

􀂾 Women experiencing Post partum bleeding – post birth bleeding – nifas

Note: Continuous bleeding though out the month experience by some women, has to

make fresh wudu for each obligatory prayer, and then she can pray sunnah or nafil salah

or read quran till other obligatory salah.

All these things dictate that you wash your entire body, you do ghusl.

b) Hadith al asgar – lighter state of ritual impurity.

􀂾 Going to bathroom to relieve etc.

􀂾 Gases leak

Just wash the external limbs and perform wudu – no need to wash the entire body.

Water – two types mentioned by author but the shaik is going to mention 3 types.

a) Tahoor - Water in and itself is clean and makes others clean – perform wudu

b) Mixed with some impure substance – can’t be used for wudu

c) Mixed with some pure substance. Water which is clean but not as first cater gory,

mixed with something which is clean like vinegar, tea … etc.

Small amount of microbe impurities does not make the water impure.

Principle rule of Shariah: Everything is pure and permissible unless stated otherwise. If

there is no evidence to prove the najasah, then it is clean and pure.

Somebody doubts whether his water or clothing are physically pure or not, then one

should follow the above rule.

Shak – doubt: Doubting between two equal factors 50% - 50% but not doubting with

60% – 40% or some other unequal percentage.

Utensils (al aniyah) – should follow the above rule, except for the utensils made of silver

and gold as mentioned in the hadith in text book. Reason for this because

􀂾 feels they are above others,

􀂾 makes the poor feel jealous.

Manners of answering the call of nature: practice of relieving yourself. ie., going to

toilet, washroom to relieve yourself.

1. make dua before entering the toilet to be protected from male and female jinn, even

someone entering the toilet to wash the cloths.

2. after leaving toilet, recite the prayer ghufranak (I seek your forgiveness) found in

authentic hadith. Another dua alhamdullahillazi ad’haba … – praise be to Allah who

protected me from harm … this dua was mentioned in sunan, many ulemah said it is

weak, it is not so authentic, so just saying ghufranak is enough.

3. Relieving in open areas – be away from people and make sure no one sees his/her

private parts.

4. Not permissible in important place where people travel such as road, people sits.. it

harms the people by relieving at such places.

One should not relieve facing/back facing Qiblah while in open area. But using toilets

inside a building this rule does not apply, because Rasoolullah sallallahu alaihi

wasallam relieved while facing kabah and baitul maqdis.

5. Clean with 3 stones or with toilet paper or tissue the affected area. But should be

dunk and bones should not be used to clean. Papers with important papers such as

money, documents and sacred texts, paper with names on it also should not be used.

Types of physical impurities and how to remove them.

1. If a dog licks any of the utensils, then supposed to wash 7 times, one of it should be

with dirt. This hadith is specific to the case if the dog licks. But if the saliva fell down

on cloths, then just washing that part one time is enough. Can we substitute soap or

shampoo instead of dirt – ulemah differed.

2. Blood spilled out / poured when sacrificed an animal: impure and haraam it is not

permitted to use. But the blood remains in flesh/muscles and veins is pure. It is

permissible to use it.

3. Wild animals: all impure – those hunt and eat them.

4. All dead animals: all impure except those which were slaughtered, fish and locust.

5. Mani Sperm: pure – which comes out of men due to sexual desire, in arosed

condition, comes out with force.

wadi – light fluid – come out from men sometimes after urination

madi – thick sticky fluid – comes out sometimes when carrying heavy things and

sometimes after performing wudu…

6. Urine of a baby boy who does not eat food out of desire: if fell down on clothes, just

sprinkle that part is enough. In case of a boy who eat food with desire, full wash of

that part is required. This rule does not include infant girl – it has to be washed in

case of infant girl.

7. Removing the physical impurity: if blood fells down on clothes, by washing its

presence, hard part is removed, still some shade is on the cloth, it becomes clean and

pure.

if you are in the building, you can use the toilet facing the qibla, or with your back facing the qibla...if you are in the open you must not face the qibla.

when blood drops on the shirt- wash it with water- if the colour of blood remains or remnants of the blodd- then your sghirt is regarded clean- you do not have to get rid of the colour and smell,, just the heart of the blood stain.

Also can you give the reference in the ahadith for the classification of awrah given?

. Very strong difference of opinion exists regarding this. The Ulamaa' in Saudi Arabia are of the view that covering the face is Waajib. This view is not specific to them and is the view of earlier scholars as well.

Sheikh al-Albaani is of the opinion that it is not 'waajib' to cover ones face. This view is not specific to him, and also is the view of certain earlier scholars.



The difference of opinion is a strong one in this regard.



However, there is no doubt that it is better to cover the face, as this is from being more chaste, and there is no doubt that if leaving the face open is a cause of 'fitna'; then covering the face is compulsory.



In your circumstance- Follow the view of the 'god- fearing' Ulamaa present in your community.

Salah performed in an unlawfully taken land cannot be performed..what happens if the person praying didn't know?

The sunnah is for it to be recited thrice- there are also other authentic narrations of other invocations that can be recited.

. refers to having the weight on the front part of your feet, i.e the balls of your feet (which is natural when one is standing)

.in the verbal pillars of salah section it was said that the first tashahhud is a pillar of salah but the 2nd tashahhud was not mentioned..aren't both the tashahhud the pillars of salah?

This was a mistake in the translation- the first tashah-hud is waajib, and the second is a Pillar. (a post will be made mentioning this error.)

can we consider the pillars of salah as Shart or conditions of salah and the obligatory acts of salah as Sunnah?

8. Pillars of Salaah are a seperate entitiy, and not like waajib or shart! Each unit of prayer has it's pillars, and if a pillar is missing, then that unit of prayer is not counted as complete, and must be repeated. This is in the case of a pillar being left out by mistake. if a pillar is left out intentionally, then the entire salaah is voidable and has to be repeated.



Q.13

He said:"All containers, utensils, silverware and the like are permissible to use except those made of Gold or Silver, or which contain them."

what is the difference between silverware and those made of silver?



The silver utensils that are forbidden for us to use is that made of pure silver which on the periodic table of elements is recorded as Ag, and is the forty seventh element, and comes under the category of metalloids.



Silverware however is a name known to represent eating utensils such as forks, knives and spoons etc.



If my memory serves me correct, and I am open to being corrected, these spoons etc cannot be made from pure silver, as silver is a soft metal as alluded to by it's position in the periodic table of elements.



It is possible to find silverware with pure silver in it's composition, but there will be the presence of other alloys present in the product.



In short- utensils that are silver in colour and do not have any silver in them can be used. Anything with pure silver is relatively more expensive and elite, and a clear differentiation will be made- and cannot be used!



Question 13:

1)What's the difference between hadath (ritual impurity) and najasah (physical impurity)? Please give examples. Can any one type of hadath be also considered as najasah? Are there any examples like that?



2) What's the difference between pillars of salaah and obligatory acts of salaah? Are the pillars obligatory and the obligatory acts pillars as well?



In regards to the first:



Hadath refers to ritual impurity such as being in a state that requires wudhu or ghusl.



Najaasah refers to physical impurity, such as spilled blood of a sacrificed animal.



Thus hadath is not najaasah...



2) The difference between a pillar and that obligatory in Salaah-





Is that a pillar cannot be left out in any circumstance- if it is left out of a unit by mkistake, the entire unit is null and void and must be repeated. If it is left out deliberately, then the entire salaah is null and void.



However if an obligation is left out by mistake- such as the 1st tasha-hud; then the unit does not have to be repeated or the salaah! but one has to make the prostration for forgetting at the end of their salaah.



But if an obligation is left out intentionally, then the entire salaah is null and void.



Thus they both share some characteristics, and differ in some others.



There are other differences which I will not delve into right now, so as not to make this answer unclear.







Q.14

Rukoo is not a pillar right? It's an obligatory act? If I omit rukoo, then can I stand up and perform it and continue? Or will sujood-as-sahw apply here? This depends on whether rukoo is pillar or obligatory. If it's obligatory, then sujood-as-sahw is enough, right? We don't need to perform the rukoo? If it's a pillar, then isn't that unit of salaah nullified? Or is it that if I don't move to the next pillar, then the salaah is NOT nullified and I still have the chance to correct my omission of rukoo?



Rukoo' is a pillar! and not from the obligatory acts. Thus,if missed- the unit of Salaah is nullified and must be repeated. Also at the end of your salaah, you must perform sujood asSahw.





Q.15

In the text book, there is a hadees which states that after praying 2 units (including tasleem) at Duhr/Asr, the Prophet (SAW) realized and so, he performed it again. Performed what? The entire salaah or just 2 more units?

The Prophet (SAW) made up the missed two units.



Q.3

In the lecture, Sheikh said (if I'm not wrong) that if we replace verbal obligations, that is say the duaa of rukoo in sujood and the duaa of sujood in rukoo, then sujood-as-sahw is not required. So in case of verbal obligatory acts, sujood-as-sahw is not applicable? Will the unit be nullified or the entire salaah?

The unit is not nullified, because this is an obligation,not a pillar.

Would like to know if these two terms are interchangeable or is one a subcategory of the other?

If I have understood that which you intend correctly, They are not interchangeable and not sub categories of another.



They are two separate groups with independent members and denotations.



The first is defining, whilst the second is declaratory.



Examples provided in the synopsis of lecture one will help insha Allah.



For example- the sun crossing the zenith is not from ahkaam atTakleefiyya,i.e. not waajib. But thuhr being waajib if the sun crosses the zenith is from the ahkaaf atTakleefiyya.



However,if you refer to every waajib act having it's conditions; then from this angle,there is a peculiar (unique) type of relationship

As I am still confused, let me try to re-state my question.



I understand there are 5 Islamic Rulings which in the lecture we were told they are called "Ahkam El Shariah".



Then the Sheikh went on to talk about Ahkam El Taklifiyah (when the rule is in the form of a demand or option). These, as I understood from the lecture were the defining laws.



So it would appear to me that they (Ahkam El Shariah, and Ahkam El Taklifiyah) are referring to the same 5 rulings, ie: Waajib, Haraam, Mubaah, Mandoob and Makrooh.



I thought that the Al Ahkam Al Wadiyah were the secondary/declatory laws. There were four of them: Shart, Maniyah, Sahih and Fasad.



the ahkaam ash-Shar'iyya are either



Waajib

Sunnah

Haraam

Makrooh

Mubaah



And these 5 are known as the ahkaam at-Takleefiyya

The shaikh mentioned that the awrah for women is different for different situations. What is awrah for going out, and awra for salat, for women?

1. Awrah going out- cover face and hands. Awrah in prayer whole body except face and hands unless you are praying in public and may be seen.



-the author said: in Salaah the entire body is an awrah for the category you discussed except a women's face. This is the view of the author.

According to the author- her hands must be covered in Salaah.



However the author is also of the view that out of Salaah; the face of a female must be covered.

The shaikh had mentioned the facility of making wudhu and wearing heavy socks or leather socks and then during the day making wudhu and wiping over the socks. Is it necessary that the socks be leather or is heavy cotton acceptable?

And what if after wearing the socks one wears shoes and during the day makes wudhu wiping over the shoes, is this proper? when the person makes salat, should he remove his shoes, or keep them on, since he has wiped over them?

Answer:The sheikh mentioned in the lesson that wiping over your socks is fine, such as cotton etc.



In regards to shoes etc, then this is already a matter of dispute,



Dr. Saalih alGhuleika, a lecturer in the faculty of Shariah at alImaam University said it is permissible if the person is wearing socks underneath.



However he said, once the shoe is taken off, then the majority are of the view that the wudhu is nullified. This too is a dispute, but he feels however that the safest way (alahwat) is for one to perform the ablution, especially in cases where one is observing the compulsory Salaah.

Tyyamum: In the lecture Sheikh mentioned that scholars differed upon types of earth to be used for tayammum. In the course of traveling in today's world, there are occassions where water is scarce or insufficient in quantity and clean earth also cannot be found in the near vicinity where one would make salah, but there is cement walkways or buildings near, can rubbing hands upon these be acceptable?

According to the most correct view as mentioned by sheikh Sa'd,



Tayammum can be done on clean earth. This is the view of Imam Abu Hanifa and coincides with the verse in the book of Allah. If the painted walls have dust on them, tayammum can be performed by patting your hands on the wall

Question:30.

I was wondering about the ruling regarding haraam. When one commits an act that is haraam, he is liable to punishment. However when one avoids that which is haraam irrespective of the oppurtunity to do so, is one rewarded?

Yes, he is rewarded for leaving it in the event of him being tempted to it, or tested by it.



The rule is



"alajru minat taqarrub ilal halaal wat takhallus

minal haraam"



(rewards are gained by performing all that which is halaal (or helps you do that halaal), and for leaving haraam (and doing all at your disposable to distance yourself from haraam)

Slight Laughter: just yesterday as i was praying dhuhr, at the time i made ruku, my 1 year-old daughter stuck her finger in my mouth and removed it. i laughed slightly....like "ha", but it was not loud. it was done in a whispered tone, the same as when reciting the dhikr of ruku. i continued praying because i believed the laughter was not enough to invalidate the prayer.

1. does something like this invalidate my prayer?

2. and if so, should it be repeated?

3. along those lines, if a person does something in ignorance (not aware of the error or not sure what to do about at that time), and it actually does invalidates the prayer, is there any time limit that he has to re-perform that prayer?

1. Ibn Qudaamah said: Ibn al-Mundhir stated: They have unanimously agreed that laughing invalidates the prayer, and most of the scholars said that smiling does not invalidate the prayer. Al-Mughni, part 1, p. 394

Clear statements from the Shaafi' and Hambali Ulamaa mention that smiling does not break ones Salaah.



2. Thus I would advise you to gauge your situation. If you feel the incident was more than a smile, than the safest answer would be for you to repeat the prayer especially if it was one of the obligatory ones.



3. The general rule states: that if we are commanded to do something, and left it out because of forgetfulness or ignorance; then the person is not sinful but has to ensure missed act is completed, or in cases like salaah- the entire salaah repeated.

However if we were prevented from doing something, and did it because of ignorance or forgetfulness- then we do not have to repeat the act.



For example- We are commanded to have ablution in order to observe the salaah. Thus if the salaah is observed without ablution because of ignorance for example- the person is not sinful, but does have to repeat the prayer.



In retrospect, we were prevented from praying with impurity on our clothes. Thus if we do so out of ignorance or forgetfulness, and learn of the impurity being present after the salaah; then the salaah does not have to be repeated.



Now someone may ask, how will we know if that missed was a 'command' or a 'prevention'??



The answer is to ask the people of knowledge who are versed with the arabic language, and the sources of the shariah.



If the prayers that are known to be invalid are a few and countable, then they should be redone. However, if there are so many that cannot be counted, for example- years of missed/incorrect salaah. Then some of the ulamaa are of the view that they should NOT be redone, but sincere forgiveness sought because Allah Almighty forgives all but shirk.









Question: 32

Gesturing During Salaah: The reality of the situations in some of the masjids in America is saddening. Sometimes a person may have to offer the obligatory prayers in the masjid by himself because no one else has showed up, wa laa hawlaa wa laa quwwaata illaa billaah. Sometimes, one may come and find another praying but not know if he is praying an obligatory prayer. And he (the one coming) wants to know so that he can possibly join and make a congregation with the one praying.

1. If that one praying is asked "are you praying dhuhr?" for example, can the one praying respond by nodding his head "yes" or "no" or by gesturing with his hand, such as raising a thumb for "yes" or wagging his finger for "no"?

2. or should the one coming just wait until he is sure that the one praying is praying the obligatory prayer, which usually is indicated by and audible takbir (Allaahu akbar) or tasmi' (sami'a Allaahu li man hamidah)?

3. what if the one coming waits for the audible takbir or tasmi', but does not hear it because the one praying says it low, should he then ask about the prayer?

In regards to your second question about gesturing...



Understand that movements in Salaah can be classed in the following catagories as explained by sheikh Uthaimeen (may Allah have mercy upon him):



1- Obligatory movements



2- Forbidden movements



3- Makrooh movements



4- Mustahabb movements



5- Permissible movements



The first refers to those movements that have to happen for the Salaah to be correct. For example, turning towards the Qiblah.



The second refers to the movements we discussed in class today- Movements that are continuous and excessive, and occur for no valid reason.



Mustahab refers to those movements that occur to make the prayer more complete, such as moving inorder to fill up a gap in the row, etc.



Permissible, refers to small movements that happen for a reason like the one you described insha Allah- a slight movement of the head to acknowledge something. This sector also includes large movements because of necessity.



Makrooh refers to what we witness today whereby people play with their clothes, hands, beard, pen, watch etc.



Also note dear brother the following fatwa from the senior Ulamaa in Saudi Arabia:



The Standing Committee was asked: what should a man do if he forgets Fajr prayer, for example, and does not remember until the iqaamah is given for Zuhr, or he forgets Zuhr and does not remember until the time for ‘Asr begins. Should he join the imam with the intention of offering the obligatory prayer that he missed or with the intention of offering the prayer that is currently due, and make up the missed prayer after that?



He replied: He should offer the prayer that he forgot behind the imam, and it does not matter if his intention is different from that of the imam, according to the sound scholarly opinion. End quote.



Fataawa al-Lajnah al-Daa’imah, 7/407.

The sunnah is to wash the mouth and rinse the nose with the same 'carry' of water-not to wash the nose separately without rinsing the mouth.

1. What is your view about a person performing its wudhu without covering its awrah? Does its wudhu permissible? Some says its makrooh..Is it true?



2. In Malaysia, after saalah, the imam always recite istighfar 3x, surah al Fatihah 1x, salawat and make duaa in front of the jamaah(the imam recite and the jamaah says amin). Does these act are from the Sunnah? If yes, are the hadith is shahih?



3. What is your view if the person make duaa thats are not taken from the sunnah(hadith)?



Answer:

It is not a condition to be covered whilst performing ablution (wudhu). However! It is more beloved that the awrah is covered at every time possible because Allah Almighty sees you! The converse of mustahab is makrooh as learnt in lesson one.



It is from this perspective that one would say it is makrooh to perform ablution whilst naked.



In regards to the invocations after Salaah...



The following fatwa of sheikh ibn Baaz (May Allah have mercy on him) will shed some light:



The Sunnah is for the Muslim to say after every obligatory prayer, whether he prayed as an imam or behind an imam or on his own: Astaghfirullaah (I ask Allaah for forgiveness) three times, then Allaahumma anta al-salaam wa minka al-salaam tabaarakta ya dhaa’l-jalaali wa’l-ikraam (O Allaah, You are the One Who is free from all defects and deficiencies and from You is all peace, blessed are You, O Possessor of majesty and honour). Then he should turn to face the people if he was the imam, then he and the other worshippers, and similarly the one who prayed on his own should say: Laa ilaaha ill-Allaah wahdahu laa shareeka lah, lahu’l-mulk wa lahu’l-hamd wa huwa ‘ala kulli shay’in qadeer. Laa hawla wa laa quwwata illa Billaah wa laa na’budu illaa iyyaah. Lahu’l-ni’mah wa lahu’l-fadl wa lahu’l-thanaa’ al-hasan. Laa ilaaha ill-Allaah mukhliseena lahu’l-deena wa law kariha’l-kaafiroon. Allaahumma laa maani’ lima a’tayta wa laa mu’ti lima mana’ta wa la yanfa’ dhaa’l-jadd minka al-jadd (There is no god but Allaah Alone, with no partner or associate His is the sovereignty and to Him be praise, and He is Able to do all things. There is no power and no strength except with Allaah, and we worship none but Him. From Him (alone) come all blessings and favours, and all good praise is due to Him. There is no god but Allaah and we make our worship purely for Him (alone) however much the disbelievers may hate that. O Allaah, none can withhold what You give and none can give what You withhold, and no wealth or majesty can benefit anyone for from You is all wealth and majesty).

After Maghrib and Fajr prayer he should say, as well as the words mentioned above: Laa ilaaha ill-Allaah wahdahu laa shareeka lah, lahu’l-mulk wa lahu’l-hamd yuhyi wa yumeet wa huwa ‘ala kulli shay’in qadeer (there is no God but Allaah alone, with no partner or associate, His is the Dominion and to Him be praise, He gives life and gives death, and He has power over all things)ten times. Then after that he should say Subhaan Allaah wa’l-hamdu Lillaah wa Allaahu akbar (Glory be to Allaah, praise be to Allaah and Allaah is most great) 33 times, and to complete one hundred he should say: Laa ilaaha ill-Allaah wahdahu laa shareeka lah, lahu’l-mulk wa lahu’l-hamd wa huwa ‘ala kulli shay’in qadeer (There is no god but Allaah Alone, with no partner or associate His is the sovereignty and to Him be praise, and He is Able to do all things).

The Sunnah is for the imam, the person who prays on his own and the person who prays behind an imam to recite these adhkaar out loud after every obligatory prayer in a moderate voice that is not too loud, in an ordinary tone. It is proven in al-Saheehayn from Ibn ‘Abbaas (may Allaah be pleased with him) that raising the voice in dhikr when the people have finished the obligatory prayer was what was done at the time of the Prophet (blessings and peace of Allaah be upon him). Ibn ‘Abbaas (may Allaah be pleased with him) said: I would know that they had finished when I heard that.

It is not permissible to recite out loud in unison; rather each person should recite to himself without paying attention to the voice of anyone else, because reciting dhikr in unison is an innovation for which there is no basis in Islam.

Then it is prescribed for the imam, the people praying behind an imam and the one who is praying alone to recite Aayat al-Kursiy silently, then for each of them to recite Qul Huwa Allaahu Ahad, Qul a’oodhu bi Rabbi’l-Falaq and Qul a’oodhu bi Rabbi’l-Naas [i.e., the last three soorahs of the Qur’aan] silently. After Maghrib and Fajr one should repeat Qul Huwa Allaahu Ahad, Qul a’oodhu bi Rabbi’l-Falaq and Qul a’oodhu bi Rabbi’l-Naas three times. This is the best because of the soundness of the reports that indicate all that we have stated above.

May Allaah send blessings and peace upon our Prophet Muhammad and his family and Companions and those who followed them in truth until the Day of Judgement. End quote.

1.Yes it is as this is from the 'thawaat alAsbaab'(That which as a reason associated with it).



2. If there is time,then it is recommended to offer tahiyyatul masjid.



If there is no time,then join the Maghrib Salaah immediately. You don't perform tahiyyatul masjid after the Maghrib,as the Maghrib Salaah would have taken it's place.



3. If you pray the 2 rak'aat of wudhu when entering the masjid,then you do not have to pray tahiyyatul masjid as you would have offered a prayer before sitting. If you place both intentions in one,then that is fine, and better! As you would be rewarded for both.

Does eating camel meat nullify one's wudhu?



Al-Nawawi said:



Ahmad ibn Hanbal, Ishaaq ibn Raahawayh, Yahyaa ibn Yahyaa, Abu Bakr ibn al-Mundhir and Ibn Khuzaymah thought that it (eating camel meat) breaks wudoo’; this was also the view favoured by al-Haafiz Abu Bakr al-Bayhaqi. It was reported from the scholars of hadeeth and from a group of the Sahaabah.



Their evidence is: The hadeeth of Jaabir: the Prophet (peace and blessings of Allaah be upon him) was asked, “Should I do wudoo’ after eating camel meat?” He said, “Yes.” The person said: “Should I do wudoo’ after eating mutton?” He said, “If you wish.” (Narrated by Muslim, 360).



The hadeeth of al-Baraa’: the Prophet (peace and blessings of Allaah be upon him) was asked about eating camel meat. He said, “Do wudoo’ after eating it.” He was asked about mutton, and he said, “Do not do wudoo’.” (Narrated by Abu Dawood, 184; al-Tirmidhi, 81. Classed as saheeh by Imaam Ahmad and Ishaaq ibn Raahawayh).



They took as evidence the hadeeth of Jaabir ibn Samurah which was narrated by Muslim. Ahmad ibn Hanbal and Ishaaq ibn Raahawayh said: “It has been reported from the Messenger of Allaah (peace and blessings of Allaah be upon him) in these two saheeh hadeeths, the hadeeth of Jaabir and the hadeeth of al-Baraa’. This view has stronger evidence even though the majority follow the opposite.”



The majority responded to this with the hadeeth of Jaabir: the last of the two commands from the Messenger of Allaah (peace and blessings of Allaah be upon him) was that there was no need to do wudoo’ after eating meat that had been touched by fire. But this hadeeth is general, whereas the hadeeth about doing wudoo’ after eating camel meat is specific, and a specific ruling takes precedence over a general one. (Sharh Muslim, 4/49).

Among modern scholars, Shaykh ‘Abd al-‘Azeez ibn Baaz, Shaykh Ibn ‘Uthaymeen and Shaykh al-Albaani also said this.

His Salaah is valid if he reads without a sutra, but he is prone to distraction from shaitaan and those around him, and thus would at times decrease his rewards.



The person who walks in front of them does not cause the prayer to be invalid unless if that person is an adult female, because of a hadith found in the sunnah. the Prophet (peace and blessings of Allaah be upon him) said: “The prayer of a Muslim man is invalidated if he does not have in front of him something like the back of a saddle, by (the passage in front of him of) a woman, a donkey or a black dog.” Narrated by Muslim in his Saheeh from the hadeeth of Abu Dharr (may Allaah be pleased with him). Muslim also narrated it from Abu Hurayrah (may Allaah be pleased with him), without mentioning the word black. The basic principle is that a general statement is to be interpreted in terms of the specific statement. In the hadeeth of Ibn ‘Abbaas it says “A woman who menstruates” i.e., an adult woman. The correct view is that which is indicated by the hadeeth: that these three invalidate the prayer.



Some of the Ulamaa are of the view that the passing of an adult female does not invalidate the prayer because the Prophet SAW used to pray whilst Aisha RA was laying in front of him. The 1st group answer this hadith by stating that laying in front of a person is not the same as passing in front of him in front of him.

The fatwa from the senior scholars in Saudi Arabia is as follows:



in the cases where she is permitted to recite Qur’aan, she is also permitted to do Sajdat al-Tilaawah, if she happens to recite or hear a verse where the sajdah is prescribed. The correct view is that it is permissible for her to recite from memory, not from the Mus-haf, so on this basis the sajdah is prescribed for her, because it is not salaah (prayer), rather it is an act of submission to Allaah and worship, like other kinds of dhikr.

Secondly: the correct view is that it is not a condition for sajdat al-shukr and sajdat al-tilaawah on the part of one who is reciting or listening, that the person should be in a state of tahaarah (ritual purity), because they do not come under the rulings of salaah.

2 Units of prayer are offered with 2 bowings (Rukoo aan) in each unit. So the Imam recites faatiha and part of the Qur'aan and then bows. He then stands from the bowing and recites faatiha and part of the Qur'aan again, without prostrating. He then bows and prostrates completing the first unit of prayer.



The same is done in the second unit of prayer.

my question is: whether females have to cover their head on entering the bathroom?

I know of no authentic narration that stipulates this. There is a weak narration in alBayhaqi, if my memory serves me right, that mentions the Prophet SAW as using the lavatory with his head covered, but it is weak.



Some Ulamaa allow weak narrations to be used as evidence in other 'good practices' along with certain conditions.



Thus the most that 'can be said' is that it is a better practice to do so. Thus there is no sin if not done.

Jumuah salaah is not waajib upon females as mentioned in your notes.

Yes he has caught the jumuah prayer, and only makes up one unit of prayer, he does not observe Thuhr...



However if he misses the second Rukoo' he completes the salaah as thuhr..

You are certain that you made wodoo, but you doubt whether you broke you wodoo or not. Then this principle takes place and you are considered to being upon wodoo.



2. You have a ring wich you found which looks like gold but you are not certain whether it is real or fake, thus a man is permitted to wear it. Or where you have a plate with a decoratice line (as I myself asked during the lesson) which looks like gold, but you are not certain if it is paint or real gold. Then in these two cases you have no evidence to proove one over the other so the outset is that they are permissable wa Allahu ta'ala alam.



Now, my confusion arises when I try to find an example that is a shubh. When reading the english translation (or swedish, it tends to be better translated into english) you read that the Prophet adviced us to refrain from the shubuhaat, it would be like a man who lets his sheep pasture on the border to another mans land - sooner or later the sheep will cross the border. So, if we indulge in shubuhaat that will maybe lead us to haram. Is this understanding correct? (what would be the wording in arabic?). Could I be provided with an example to better understand the differences?

'Shak' (doubt) refers to 2 equal probabilities, and you do not lean to any of the 2 probabilities...



For example you doubt whether you still have wudhu.



You do not know.... 'do i' or 'don't I'



In the example you described- we say, what is the last thing you are sure of?? having performed ablution? or having done that which nullifies ablution.



If a person says, I remember performing Ablution at 6am, and doubt doing that which nullifies wudhu.



ie..you say..



I could have done it, but could not have done it...



In this instance we say 'alyaqeen laa yazoolu bish shak'



"certainty is not abolished by doubt."



So we say if you certain about performing ablution, and doubt breaking your state of ritual purity- then in that instance you are in a state of ritual purity because the doubt you now experience does not affect ablution that you are certain of performing that put you in a state of ritual purity at 6am.



I hope this clarifies this issue...



In regards to 'shubha'



It largely refers to 'misconception'- and this is the word i desperately searched for during the translation ;) !!



So you have a thought about something, with no evidence to substantiate it.



However, understand that 'shubha' in context can refer to another meaning as well....



For example, the fuqahaa say: We can not cut of the hands of the thief, because he actually stole from his father...



The ulamaa refer to this as a 'shubha'



That is: a clear situation has now become doubtful, because a father is supposed to spend on his son in the first place- and we are only allowed to carry out capital punishment in clear 'undoubted' circumstances...



I hope this example offers some guidance.

JazakAllahu khairan. Alhamdulillah I do understand the meaning of shak. However, I want to understand what a shubha would conctitute for an individual regarding ahkam or issues of permissable/impermissable; as I understood the ahadeeth about this matter it was directed towards individuals as well as on a higher level (i.e to avoid the shubuhaat). For example, rennet. There are two views, both sides have their arguments. Could we say in this situation "Ok, this is a doubtful matter and I prefer to be on 'the safe side'" - Would this be a correct understanding?

yes from the meanings of shub'haat, depending on the context, is those things you not sure about....



like that which you have described...



For a person who does not have any evidence to substantiate any of the factors...



we say, this is a shub'hah,



meaning...that which is doubtful.



However bare in mind that this doubt differs to the doubt in 'shak'



The principle here, is that 'shu'bhaat' has several meaning depending on it's the context in which it is used- and a person with a founding in the Arabic language, and is familiar with the statements of the fuqahaa' manage to make the necessary distinctions.

In regards to the awrah becoming exposed in Salaah...



The Ulamaa are unanimous that prayer with the awrah not covered with no reason invalidates the prayer, and thus be repeated.

If one is making up missed witr salaah as 4 raka'aat how is this done as 2+2 or 4 all together?

If your witr consists normally of one unit, then you pray 2 units. And if it consists of three units, then your pray 4 units as a whole, without qunoot.

2. In salah after Ruku what to do?

You should stand together shoulder to shoulder not leaving gaps between you and your neighbour. You should also ensure that your heels are in a straight line.



It was narrated from Anas ibn Maalik (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said: “Straighten your rows, for straightening the rows is part of perfecting prayer.” Narrated by al-Bukhaari, 690; Muslim, 433. According to another report narrated by al-Bukhaari (723): “Straighten your rows, for straightening the rows is part of establishing prayer.”



It was also narrated that Abu Mas’ood (may Allaah be pleased with him) said: The Messenger of Allaah (peace and blessings of Allaah be upon him) used to touch our shoulders when we were praying and he would say: “Make the rows straight and do not differ, lest your hearts differ.” Narrated by Muslim, 432.



And it was also narrated that al-Nu’maan ibn Basheer (may Allaah be pleased with him) said: The Messenger of Allaah (peace and blessings of Allaah be upon him) used to straighten our rows, as if he was straightening the shaft of an arrow, until he saw that we had learned it. Then he came out one day and was about to say the takbeer, when he noticed a man whose chest was sticking out from the row. He said: “Slaves of Allaah! Make your rows straight or Allaah will cause discord among you.” Narrated by al-Bukhaari, 717; Muslim, 436.

It is recommended to recite it softly, according to the preferred opinion, in every unit of prayer.

Considering the opinion that there is no prayer without surat Al Fatiha when joining a congregational if the imam has completed surat al fatiha is it incumbent upon me to repeat this rak'ah. In many discussion such as in the last lesson referring to Jumuah Salah it was mentioned the rak'ah must be compensated if one has missed the ruku. I pray this question is understood in the best of ways and Jazakallah for all of your efforts

This is because the Prophet SAW did ask the man who did this to repeat that unit.



It was narrated in a saheeh report that Ibn Mas’ood (may Allaah be pleased with him) said: “Whoever does not catch up with the imam when he is bowing has not caught up with that rak’ah.” Narrated by al-Bayhaqi; classed as saheeh by al-Albaani in Irwa’ al-Ghaleel, 2/262.



Ibn ‘Umar said: “Whoever catches up with the imam when he is bowing and bows before the imam raises his head, has caught up with that rak’ah.” Narrated by al-Bayhaqi and classed as saheeh by al-Albaani, op. cit., 2/263.



Also note that this is a point of difference between the Ulamaa.

as for the complete process it should be in order-is the order as mentioned in the notes or aayah of surah al-maidah:6 and for the second aspect does it mean that washing each part once?

The 'lesser than complete' manner would refer to doing all the compulsory acts whilst leaving out the recommended acts when performing ablution.

If salaatud duhaa is prayed at the beginning of it's time-you can call it salaatud duhaa' or salaat atTashreek. However if it is observed towards the middle or end of it's time,then it is called salaatud duhaa'.



-According to our sheikh, Salaat at Tasbeeh is not established in our shariah,thus we must not observe it.



-According to our sheikh- correct view is that both khutbah and Salaah (jumuah) can take place before midday- however it is better to do it after midday. This is so that we can come out of the difference of opinion, and because some sisters may hear the athaan and start performing thuhr in their homes.



-salaatul khawf (fear prayer) is not a special salaah! This chapter refers to the salaah that you perform during the times that you are fearful. For example,If you pray Asr in a war zone, or in the wild with predatory animals lurking!



This salaah has special leniencies attached to it.



The author mentioned in his notes the salaah practised during war. Our sheikh did not explain this,as he wants to add points not mentioned that apply to us currently today whilst pointing out to the fact that the notes are self explanatory.



This chapter should also teach us how important it is to render the obligatory salaah during it's time, even if it's during the times that salaah is prohibited



- A person who enters after the khateeb is sinful and must seek forgiveness.



- At the time of fear, you observe the salaah to the best of your ability before the time expires.



- According to the sheikh,the correctopinion to be considered a traveller is: travelling 40 kms not 80kms.



Please note that this is 40kms after departing the city you live in, and not your home. It is possible for people to travel 40 kms in the same city.



I advise that you listen to the recording of the session 6 again to reinforce that taken.

-the author said: in Salaah the entire body is an awrah for the category you discussed except a women's face. This is the view of the author.

According to the author- her hands must be covered in Salaah.



However the author is also of the view that out of Salaah; the face of a female must be covered.

If I have understood that which you intend correctly, They are not interchangeable and not sub categories of another.



They are two separate groups with independent members and denotations.



The first is defining, whilst the second is declaratory.



Examples provided in the synopsis of lecture one will help insha Allah.



For example- the sun crossing the zenith is not from ahkaam atTakleefiyya,i.e. not waajib. But thuhr being waajib if the sun crosses the zenith is from the ahkaaf atTakleefiyya.



However,if you refer to every waajib act having it's conditions; then from this angle,there is a peculiar (unique) type of relationship.

As I am still confused, let me try to re-state my question.



I understand there are 5 Islamic Rulings which in the lecture we were told they are called "Ahkam El Shariah".



Then the Sheikh went on to talk about Ahkam El Taklifiyah (when the rule is in the form of a demand or option). These, as I understood from the lecture were the defining laws.



So it would appear to me that they (Ahkam El Shariah, and Ahkam El Taklifiyah) are referring to the same 5 rulings, ie: Waajib, Haraam, Mubaah, Mandoob and Makrooh.



I thought that the Al Ahkam Al Wadiyah were the secondary/declatory laws. There were four of them: Shart, Maniyah, Sahih and Fasad.

the ahkaam ash-Shar'iyya are either



Waajib

Sunnah

Haraam

Makrooh

Mubaah



And these 5 are known as the ahkaam at-Takleefiyya

What is the reward we get for the Prostration of Tilaawah?

Allah's mercy is vast,and indeed there will be a great reward.



I have not come across anything specifying the exact reward,however a worshipper is closest to Allah during his/her prostration.



Also,astaken in the lesson- as a result of prostration, shaitaan goes into seclusion and blames himself. He says: the son of Adam was commanded to prostrate and did whilst I was commanded to and did not.

If a woman prays alongside a man but there is a barrier between them, such as a wall, or a gap which is wide enough for a person to stand and pray there, then the prayer is valid according to the majority of scholars among the Hanafis, Maalikis, Shaafa’is and Hanbalis.



However, the Sunnah is for the women’s rows to be behind the men, as was the case at the time of the Prophet (peace and blessings of Allaah be upon him). Al-Bukhaari (380) and Muslim (658) narrated from Anas ibn Maalik (may Allaah be pleased with him) that his grandmother Mulaykah invited the Messenger of Allaah (peace and blessings of Allaah be upon him) to a meal that she had made for him, and he ate some, then he said: “Get up and let me lead you in prayer.” Anas said: I went and got a reed mat of ours that had become blackened from long use, and sprinkled it with water. Then the Messenger of Allaah (peace and blessings of Allaah be upon him) stood, and the orphan and I stood behind him, and the old lady stood behind us, and the Messenger of Allaah (peace and blessings of Allaah be upon him) led us in praying two rak'ahs, then he left.



Ibn Hajar said in al-Fath whilst explaining this hadith: This hadeeth teaches us a number of things… that women should stand behind the men’s rows, and a woman should form a row on her own if no other woman is present. End quote.



Please also bare in mind the following fatwa from the senior Ulamaa' in Saudi Arabia:



The scholars of the Standing Committee for Issuing Fatwas said:



It is not obligatory for women to offer any of the five obligatory prayers in congregation, and their prayer in their houses is better for them than praying in the mosques, whether that is an obligatory or naafil prayer. But if she wants to pray in the mosque, she should not be prevented from doing so, on condition that she observe proper Islamic etiquette when going out and when praying, by going out fully covered, not wearing perfume, and praying behind the men. End quote from Fataawa al-Lajnah al-Daa’imah (8/213).



Question 60

What should you do if shitan comes in your prayer?

The Messenger of Allah, (peace be upon him), said to the one who complained of being distracted by shaitan during the prayer:



"That is a shaitan called Khanzab, so if you feel his presence, seek refuge in Allah and blow a mist to your left three times." He said: "I applied this advice and Allah has rid me off him."



This hadith includes two ways to get rid off the shaitan during salah. The first is asking refuge in Allah from the shaitan's evil by pronouncing the words of seeking refuge and this is permissible in this case. And the second: blowing with mist to the left three times. This is basically blowing air in a similar manner to spitting, but with a minute mist of saliva (dry-spitting), on the condition that this does not disturb or bother the person next to him, or mess the masjid.

In regards to session 5: Yes you are allowed to pray the Qadha of fajr when the sun is actually rising,as the Prophet SAW said: whoever (misses the prayer) because of sleep or forgetfulness, should make it up as soon as they remember.



Also after the fajr time sets in,you are allowed to pray those salaah that have a reason attached to them,according to the preferred view, such as tahiyyatul masjid, sunnah of fajr, funeral prayer etc.



Only General salaah is prohibited during these times.

Dear Sheikh please clarify on the rulings of Tashahus wether to shake the finger or not pls explain me

Wa'alaykum salam, below is a detailed article by Sheikh Saalih Munajjid explaining the matter.



Akh Sajid



Praise be to Allaah.

Firstly:



It is proven that the Prophet (peace and blessings of Allaah be upon him) used to point with his index finger and move it during the tashahhud when praying.



The scholars differed concerning that and there are several points of view.



1 – The Hanafis say that the finger should be raised when saying “Laa (no)” in the phrase “Ash-hadu an laa ilaaha ill-Allaah (I bear witness that there is no god except Allaah)” and it should be lowered when saying, “ill-Allaah (except Allaah).”



2 – The Shaafa’is say that it should be raised when saying “ill-Allaah.”



3 – The Maalikis say that it should be moved right and left until one finishes the prayer.



4 – The Hanbalis say that one should point with the finger when saying the name of Allaah, without moving it.



Shaykh al-Albaani (may Allaah have mercy on him) said: There is no basis for any of these definitions and manners in the Sunnah. The closest of them to the correct view is the Hanbali view, were it not that they limited raising the finger to when saying the name of Allaah.

Secondly:



With regard to the evidence concerning this issue:



(a) It was narrated that ‘Abd-Allaah ibn al-Zubayr said: When the Messenger of Allaah (peace and blessings of Allaah be upon him) sat during the prayer, he would place his left foot between his thigh and calf, and tuck his right foot underneath him, and place his left hand on his left knee, and place his right hand on his right thigh, and point with his finger.



Narrated by Muslim, 579.



In al-Nasaa’i (1270) and Abu Dawood (989) it says: “He used to point with his finger when making du’aa’ but he did not move it.”



This addition – “but he did not move it” – was classed as da’eef by Ibn al-Qayyim in Zaad al-Ma’aad, 1/238. It was also classed as da’eef by al-Albaani in Tamaam al-Minnah, p. 218.



(b) It was narrated that Waa’il ibn Hajar said: I said: I will certainly watch how the Messenger of Allaah (peace and blessings of Allaah be upon him) prays. So I watched him and he stood up and said takbeer (“Allaahu akbar”), and raised his hands until they were level with his ears. Then he placed his right hand on his left hand, wrist and lower forearm. When he wanted to bow, he raised his hands likewise, and put his hands on his knees, and when he raised his head he raised his hands likewise. Then he prostrated and put his hands level with his ears, then he sat with his left foot tucked underneath him and put his left hand on his left thigh and knee, and he put the edge of his right elbow on his right thigh. Then he held two of his fingers and made a circle, then he raised his forefinger and moved it, making du’aa’ with it.



Narrated by al-Nasaa’i, 889; classed as saheeh by Ibn Khuzaymah, 1/354; Ibn Maajah, 5/170; classed as saheeh by al-Albaani in Irwa’ al-Ghaleel, 367.



Shaykh Ibn ‘Uthaymeen quoted this hadeeth – “moving it, making du’aa’ with it” – as evidence that moving the forefinger during the tashahhud should be done with every phrase of the du’aa’. He said in al-Sharh al-Mumti’:



The Sunnah indicates that he should point with it when making du’aa’, because the wording of the hadeeth is “moving it, making du’aa’ with it”. So every time you make du’aa’, move your finger thus indicating the exalted nature of the One to Whom you are addressing your du’aa’s. So we say:



“Al-salaamu ‘alayka ayyuha’l-Nabiyyu (peace be upon you, O Prophet)” – you should point your finger because this salaam is a kind of du’aa’. “Al-salaamu ‘alayna (peace be upon us)” – you should point your finger. “Allaahumma salli ‘ala Muhammad (O Allaah, send blessings upon Muhammad)” – you should point your finger. “Allaahumma baarik ‘ala Muhammad) O Allaah, send blessings upon Muhammad)” – you should point your finger. ‘A’oodhu Billaahi min ‘adhaab jahannam (I seek refuge with Allaah from the torment of Hell)” – you should point your finger. “Wa min ‘adhaab al-qabr (and from the torment of the grave)” – you should point your finger. “Wa min fitnat il-mahya wa’l-mamaat (and from the trials of life and death)” – you should point your finger. “Wa min fitnat il-maseeh il-dajjaal (and from the tribulation of the Dajjaal) – you should point your finger. Every time you make du’aa’ you should point your finger, indicating the greatness of the One to Whom you are making du’aa’. This is closer to the Sunnah. End quote.



Thirdly:



It is Sunnah when pointing to look at your finger.



Al-Nawawi said:



The Sunnah is not to let your gaze go beyond the pointing finger. There is a saheeh hadeeth concerning this in Sunan Abi Dawood. You should point in the direction of the qiblah and intend when pointing to affirm the Oneness of Allaah and exclusive devotion to Him.



Sharh Muslim, 5/81.



The hadeeth to which al-Nawawi (may Allaah have mercy on him) referred is the hadeeth of ‘Abd-Allaah ibn al-Zubayr quoted above. The version narrated by Abu Dawood is (989): “And he should not let his gaze go beyond his pointing finger.” Classed as saheeh by al-Albaani in Saheeh Abi Dawood.



Fourthly:



It is Sunnah to point with it towards the qiblah.



It was narrated from ‘Abd-Allaah ibn ‘Umar that he saw a man moving pebbles with his hand whilst he was praying. When he finished, ‘Abd-Allaah said to him: “Do not move pebbles whilst you are praying, for that comes from the Shaytaan. Rather do what the Messenger of Allaah (peace and blessings of Allaah be upon him) used to do. He put his right hand on his thigh and pointed with the finger that is next to the thumb towards the qiblah, and he fixed his gaze on it.” Then he said: “This is what I saw the Messenger of Allaah (peace and blessings of Allaah be upon him) doing.” Narrated by al-Nasaa’i, 1160; Ibn Khuzaymah, 1/355; Ibn Hibbaan, 5/273. classed as saheeh by al-Albaani in Saheeh al-Nasaa’i.



Fifthly:



Bending the finger slightly when pointing was mentioned in the hadeeth of Numayr al-Khuzaa’i, narrated by A u Dawood, 991, and al-Nasaa’i, 1275.



But this is a da’eef (weak) hadeeth.

Question:64

What is the reward we get for the Prostration of Tilaawah?

Allah's mercy is vast,and indeed there will be a great reward.



I have not come across anything specifying the exact reward,however a worshipper is closest to Allah during his/her prostration.



Also,astaken in the lesson- as a result of prostration, shaitaan goes into seclusion and blames himself. He says: the son of Adam was commanded to prostrate and did whilst I was commanded to and did not.

1) In question one, if I miss a ruku and give sijda in the first raka'ah, and start the second raka'ah, then the second raka'ah has to be counted as the first raka'ah--- if I heard the lecture properly, then this case was mentioned. the second raka'ah becomes the first raka'ah, when we miss a ruku in first raka'ah--- it means that the second raka'ah entirely, starting from surat al fatihah becomes the first raka'ah---is this it?



1.Yes the 2nd becomes the first.

for sujood of gratitude, does one need to have wudoo?



2. According to the view that sujood ash-shukr is not salaah, you do not need wudhu to perform it. This is the preferred view.

Q.67

can we make other duas, when in sujood of tilaawah, after saying SubhanaRabbiyalA'ala 3-10 times?

. The sunnah is to say what was mentioned, and other invocations said by the prophet SAW during the sijdah atTilaawah.



Q.68

As for the part that one must not prostrate like a dog, people often name this type of sajda as "doggy sajda". Is it ok to name a sajda in this way or should we avoid naming it so, because sajda is a thing of huge importance and blessings...naming it in this manner sounds bad?



I would not advise this type of naming, as 'sijda' is said to be done and complete when a person does it properly. When done imitating a 'dog', we say, the Prophet SAW prevented us from doing it that way- and not give it derogatory terminology.



We must be extra careful to the words we use, especially with regards to our pure religion. Our religion is elevated despite the names we give or the conduct we exercise. It does not require our praise or appraisal. However, we must, out of respect, be particular when we use our tongue.

I did not understand the part in the first week note-- what is meant by pillars active in nature and verbal in nature.



Some pillars are verbal. Meaning they must be recited. Others are active. This means they are practised physically, and not verbally

Q.70

Here I have seen everyone linient with the matters of Ikhtilaaf, Alhamdulillah. I saw people fight a lot with matters of ikhtilaaf. How should we deal with people who follow a different view from that which we follow? This is becoming a big fitnah in our lives. Subhanallah, I saw learned Sheikhs never offend people following a different opinion.



The manner of dealing with one another despite difference is manifest in the pious before us. We should learn our history and give due diligence to these lessons.



The only people who make matters of difference an issue, especially when both views have substantiating evidence are those that are ignorant.



Every view reached by the pious and guided before us was done so with the fear of Allah, and prior research. If a mistake was made, and a weaker view given presidence; then good manners dictates that we respect that research but only follow the truth.



Also with matters of difference; the Ulamaa should be the body that mention it and correct it. Not those with 'half knowledge'- because half knowledge is worse than non, and a bigger problem could erupt as a result of one's correction which is free from perception.



In any case, this is a huge topic of discussion, and the ulamaa of usool alFiqh have discussed this at length.
